The National Highway Traffic Safety Administration opened an investigation Friday, Sept. 4, into Tesla’s self-certification of the Cybercab, one day after the automaker began carrying passengers in the purpose-built robotaxi in Austin, Texas.

The agency’s Audit Query will examine whether the two-seat vehicle complies with federal motor-vehicle safety standards despite being designed without a steering wheel or pedals. The inquiry puts an immediate regulatory test in front of a product central to Tesla’s plan to expand from selling cars into operating and supplying autonomous transportation.

Regulators want the technical basis for Tesla’s certification

Automakers certify that their vehicles meet Federal Motor Vehicle Safety Standards before bringing them to market. NHTSA can then audit those claims and demand supporting engineering data. In its Sept. 4 announcement, the agency said it will assess the basis for Tesla’s certification that Cybercab complies with every applicable standard.

The question is not whether autonomous vehicles may eventually operate without traditional controls. NHTSA is already rewriting rules involving brake pedals, rearview mirrors, lighting and windshield wipers for vehicles built around automated driving. The immediate issue is whether Tesla’s commercial deployment complies with the standards in force today.

TechCrunch reported that the agency will review Tesla’s certification process, technical data and any determination that particular standards do not apply to Cybercab. Opening an Audit Query is not a finding that Tesla violated the law.

The launch raises the stakes for Tesla’s autonomy strategy

Tesla began offering Cybercab rides in limited areas of Austin on Thursday. The company’s rider information describes the vehicle as a fully autonomous two-seater that uses cameras and sensors to navigate without a steering wheel. Tesla already operates a broader robotaxi service using Model Y vehicles in several Texas and Florida cities, but the Cybercab is the first model designed specifically around removing manual controls.

The commercial launch therefore matters beyond the initial fleet. Tesla has presented Cybercab as both an operating platform for its own network and a vehicle that could eventually be sold to fleet owners. Any required redesign, exemption process or operating restriction could affect deployment schedules, capital planning and the economics of that expansion.

The Associated Press reported that Tesla did not immediately respond to a request for comment. The company faces other federal reviews involving its automated-driving systems, although those inquiries concern different products and conduct.

A precedent shows why the process can shape the market

NHTSA previously used an Audit Query to examine Amazon-owned Zoox’s certification of a robotaxi without conventional controls. Zoox later pursued a temporary federal exemption before receiving approval in July to operate a limited commercial fleet. That history does not determine Tesla’s outcome, but it shows how vehicle design, federal rules and fleet scale can become linked.

For autonomous-vehicle companies, the Cybercab review is a reminder that software capability is only one part of commercialization. Vehicle certification, local operating authority, insurance, emergency procedures and regulatory reporting all influence how quickly a service can grow.

What business leaders should watch next

NHTSA has not announced a timetable for completing the audit or said it will halt Cybercab rides. The next material signals will be whether the agency requests changes, whether Tesla limits the Austin service and whether the company seeks a formal exemption for standards written around human-operated vehicles.

The investigation also creates a broader test for the emerging robotaxi market. A clear, repeatable federal path could give operators and fleet buyers more certainty. A disputed or prolonged process could raise the cost of deploying vehicles built without manual controls. For Tesla, the central question is now whether its fastest route to scale also satisfies the rules governing the road.
